Kentucky Industrial Alliance sues Cave City over data center moratorium near Mammoth Cave

A proposed $4.8 billion AI data center in rural Kentucky has collided with a 12-month moratorium, and now the developer is taking the city to court. Kentucky Industrial Alliance is suing Cave City over what it calls an illegitimate freeze on data center construction, enacted just as the company submitted its development plans. The Cave Point project and the moratorium Kentucky Industrial Alliance wants to build what it calls the Cave Point Commerce Center on roughly 600 acres north of downtown Cave City. The facility would be a hyperscale AI and cloud computing operation spanning ten buildings with a planned capacity of up to 1.2 gigawatts. The developer submitted its plans around May 11, 2026. Shortly after, Cave City’s council enacted a 12-month moratorium on data center development. Kentucky Industrial Alliance has now filed two separate lawsuits. The first challenges the moratorium itself, arguing it was enacted specifically to block a project that had already entered the approval pipeline.
